Pursuant to Article IX and with reference to Article II of Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina, and Article 37 para. 1 i) of the Rules of Procedure of the Presidency of  BiH (Official Gazette of Bosnia and Herzegovina no. 25/2001 of 12 October 2001), at its 119th session held on 21 December 2001 the Presidency of BiH adopted a:

DECISION

ON THE COMMISSION TO PRESERVE NATIONAL MONUMENTS

Article 1.

This Decision sets out the basic principles and aims and regulates the organizational issues required to perform the tasks of the Commission to Preserve National Monuments (hereinafter: the Commission), sets out its primary tasks and authority, stipulates the term for which members of the Commission are appointed, and defines other issues of importance for the Commission.

Article 2.

The Commission is an institution of Bosnia and Herzegovina established by Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina.

Article 3.

 The Commission's headquarters are in Sarajevo. The Commission may arrange to carry out some of its functions elsewhere than at its headquarters.

Article 4.

The Commission shall receive and rule on applications to designate the property as a national monument because of its cultural, historic, religious or ethnic importance, as provided for by Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina.

Article 5.

The Presidency of BiH shall appoint five members of the Commission without open competition. Members of the Commission shall be appointed for a term of five years and may be reappointed. Persons who are highly qualified, corroborated by scholarly work and other activities, including involvement in the preservation and protection of the cultural, historical, religious, and other material civilizational heritage, shall be eligible for appointment as members of the Commission and their families, who are not citizens of Bosnia and Herzegovina shall be accorded the privileges and immunities stipulated by Article III para. 3 of Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina.

Article 6.

The Commission shall have appropriate facilities and a professionally competent staff, generally representative of the ethnic groups comprising Bosnia and Herzegovina, to assist it in carrying out its functions. The staff shall be headed by an executive officer, who shall be appointed by the Commission.

Article 7.

The Commission shall promulgate rules and regulations governing appropriate cooperation with the relevant organs of BiH and the entities.

Article 8.

The Commission shall be financed from the Budget of the institutions of BiH. Additional methods of financing shall be provided for by separate internal acts of the Commission which shall be approved by the Council of Ministers of BiH. The material and financial affairs of the Commission shall be governed by a Rulebook which shall be adopted by the Commission subject to the prior approval of the Council of Ministers of BiH.  Provisions governing the salaries and expenses of the Commission and its staff shall form an integral part of the said Rulebook.

Article 9.

The Commission's internal organization shall be prescribed by a Rulebook on internal organization adopted by the Commission subject to the prior approval of the Presidency of BiH within 60 days of the date of entry into force of this Decision. The Commission's international cooperation shall be governed by a separate act moved by the Commission and adopted by the Presidency of BiH.

Article 10.

The procedure for the adoption of the individual acts specified in Article V of Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina, with reference to Article 4 of this Decision, shall be prescribed by Rules of Procedure to be adopted by the Commission.

Article 11.

This Decision enters into force on the date of its adoption and shall be published in the Official Gazette of Bosnia and Herzegovina.

            Dr Zeynep Ahunbay is hereby appointed to the Commission to Preserve National Monuments, replacing Dr. András J. Riedlmayer.

ON AMENDMENTS TO THE DECISION ON THE

COMMISSION TO PRESERVE NATIONAL MONUMENTS

Article 1.

Article 3.a., reading: ''The Commission shall have its own seal.  The form, appearance and use of the seal shall be determined in accordance with the law'' is hereby inserted following Article 3 of the Decision on the Commission to Preserve National Monuments (Official Gazette of BiH no. 1/02)

Article 2.

Additional paras. 4 and 5 are inserted following para. 3 of Article 5, reading: ''A member of the Commission may be employed by the Commission. ''Members of the Commission shall receive remuneration for their work for the Commission and reimbursement of other expenses incurred in relation to their work for the Commission.'' The current para. 4 becomes para. 6.

Article 3.

In Article 6, para. 3 is inserted following para. 2, reading: ''The executive officer and staff of the Commission are employees of the Commission.''

Article 4.

Article 7 is amended to read: ''The Commisison shall adopt general acts prescribing: - the Commission's method of operation; - the procedure for the adoption of individual acts as provided for by Article V of Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina; - cooperation with the relevant institutions and organs of Bosnia and Herzegovina and the entities; - the material and financial affairs of the Commission, including salary levels and other remuneration of members of the Commission and its staff; - other matters of importance for the work of the Commission.''

Article 5. 

In Article 8 para. 1, the full stop at the end of the paragraph is replaced by a comma and followed by the words: ''and other additional forms of financing.'' Para. 2 is deleted and replaced by a new para. 2 reading: ''The Commission has its own separate account for the purposes of carrying out its regular functions.'' Para. 3 is deleted.

Article 6.

Article 10 is deleted.

Article 7.

This Decision enters into force on the date of its adoption and shall be published in the Official Gazette of Bosnia and Herzegovina.

ON THE APPOINTMENT OF MEMBERS OF THE COMMISSION TO

PRESERVE NATIONAL MONUMENTS

I.

The following are appointed as Members of the Commission to Preserve National Monuments:

  •     Mr. Faruk Kapidžić, B.Sc. Eng. architecture,
  •     Mrs. Anjelina Ošap Gaćanović, Master of Architecture,
  •     Mr. Zoran Mikulić, B.Sc. lawyer, having passed the bar and advocacy exam.

II.

The mandate of the members of the Commission to Preserve National Monuments lasts for five (5) years.

III.

This decision enters into force on the day of its adoption, and will be published in the "Official Gazette of Bosnia and Herzegovina".
